If you take into consideration Pres. Obama’s SC nominee Kagan’s quote, “An unambiguous-invocation requirement for the right to remain silent and terminate questioning strikes the appropriate balance between protecting the suspect’s rights and permitting valuable police investigation,” as she said in court papers, it would appear this is not a right wing obfuscation, but a bi-partisan opinion and clarification.

The right wing of the court ruled. She’s not on the court. She’s trying to get approved. Time will tell about whether she’s right or left.
Meanwhile, if someone told you, “You have the right to remain silent,” would you think that gave you the right to remain silent?
Too bad the poor guy didn’t realize he was supposed to say, “I know I have the right to remain silent, and I hope that by not remaining silent now, I have not forfeited my right to remain silent, but I would like to remain silent.”
Of course, had he done that, the right wing would have ruled he didn’t remain silent enough. Gotcha!

Or, he could remain silent for 10 hours while the cops question him incessantly, and finally break down and say, “Alright, already, I did it, now leave me alone.” He broke his silence and the cops said, “GOTCHA”.

Exactly. Last week that confession would be disallowed. Today, they can question him indefinitely, without a lawyer (because he didn’t specifically ask for a lawyer), and finally coerce a confession out of him.
We have a trial here in Chicago. A cop tortured suspects into confessing. Many innocent people were in jail for 20+ years. Mental coercion can be as bad as physical.
The right wing is more interested in convicting the guilty, and who cares if a few innocent also are convicted. The left wing would rather see some guilty go free, rather than have an innocent man go to jail.
You can take your choice as to which philosophy appeals to you.

I don’t consider myself a right wing or left wing. Why are there only two classifications? Why must one choose sides? If one has a heart and does what the heart dictates, there will be no need for right or left. It’s all dependant upon the middle, the main body, the chest, the heart. Let the right wing and left wing argue amongst themselves and let the heart rule. There will never be agreement between the right and left, so why leave it up to either. Let the main body, the populace dictate with the heart what is right or wrong.
We have long allowed the wings to control and it is high time to stop the wings from dictating to the body. It has to start somewhere, let it start now, in you, me and anyone else who sees the loss of control by the body. From a grain of sand spreads the beach into the ocean. From an acorn grows the mighty oak. From an idea lights the world.
